Terms of Service — Social Media Project App

These Terms of Service ("Terms") govern the Social Media Project content publishing tool ("the App" or "the Service"). By connecting a social media account (including TikTok) to the Service or otherwise using it, you agree to these Terms.
Scope
These Terms apply only to the App described below. This website also offers real estate management services, which are separate from the App and are governed by their own, separate terms — not by this document.
1. What the Service does
The Service is an internal content production and publishing tool. It creates short-form video content and publishes it to social media accounts that we own and control, including via TikTok's Login Kit and Content Posting API, YouTube, Instagram, and Threads. The Service is operated by us for our own accounts; it is not offered as a public product for third parties to connect their own unrelated accounts to. Some of the App's videos are used for real-estate lead generation ("We Buy Houses" content); that use is covered here only to the extent it involves the App's publishing and comment-capture functions (see Section 5) — it does not extend to our separate real estate management services.
2. Platform compliance
Use of the Service to connect to and publish on TikTok is subject to, and we agree to comply with, TikTok's Terms of Service, Developer Agreement, and Community Guidelines, including accurate disclosure of AI-generated content and any paid or branded partnerships, and TikTok's rules on privacy levels for automated posting.
3. Content ownership and rights
Content published by the Service is either originally produced by us, licensed stock media, or derived from source material we have the rights or permission to use, with added commentary, branding, and captions. We are responsible for ensuring published content complies with applicable platform policies and law.
4. Acceptable use
The Service will not be used to post unlawful content, spam, or content that violates the policies of the platform it is published to. We reserve the right to disable a platform connection (including TikTok) at any time.
5. Lead-generation content
Where our videos invite viewers to leave contact information in comments to request a follow-up about a real estate inquiry, our handling of that information is described in our Privacy Policy. Leaving such information is voluntary.
6. No warranty
The Service is provided "as is." We make no warranty that publishing will be uninterrupted or error-free, including due to changes in a platform's API, policies, or availability.
7. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from use of the Service or from actions taken by a third-party platform (such as TikTok) with respect to a connected account.
8. Governing law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of those courts.
9. Changes to these Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date.
